Drug Testing Case
Drug testing in the workplace began during the mid 80s. The US Navy began testing following the USS Nimitz incident in 1982. The Drug-Free Workplace Act of 1988 requires companies to maintain drug-free workplaces if they wanted to get federal contracts. Drug testing by companies and corporations comply with many laws and requirements. The benefits of testing include lower insurance costs and productivity increases. The method of urinalysis is also less intrusive than other methods of testing, with the added benefit of social responsibility.
Drug addicted employees often display certain patterns in behavior that would justify them being tested. Behavior such as frequent tardiness or absence from work, poor concentration, forgetfulness, missed deadlines and frequent mistakes, mood changes, risk taking, and frequent accidents. When employers see these signs in their employees behavior, it justifies a random drug test. There are huge impacts on the employers when employees are abusing drugs that could lead to loss of revenues, property damage, decline in employee morale, lawsuits and theft. The biggest danger from employee drug abuse is in positions that could effect the lives of others, in areas of transportation and where the employee is operation machinery. The 1997 Conrail high-speed train collision cost the lives of 16 people and injured 176. The 1989 Exxon Valdez oil spill did astronomical damage to the environment and millions of the dollars to clean up. Government agencies such as the Department of Defense, Department of Energy, and Nuclear Regulatory Commission require private sector drug-testing. The major justifications for testing would be those who work in safety-sensitive positions that their work would effect the safety of themselves as well as others, people handing large amounts of money, and firearms.
